<h1><em>PATAGONIA LAUNCHES “$20 MILLION &amp; CHANGE” </em><em>AND </em><em>PATAGONIA WORKS – A HOLDING COMPANY FOR THE </em><em>ENVIRONMENT</em></h1>

<p><strong><em>Letter from Patagonia Works founder, Yvon Chouinard, announces the launch of an internal fund to help responsiblestart-up companies; reorganizes Patagonia into a new kind of holding company.</em></strong></p>
<p>VENTURA, California (May 6, 2013)</p>
<p>I don’t like to think of myself as a businessman. I’ve made no secret that I hold a fairly skeptical view of the business world. That said, Patagonia, the company my wife and I founded four decades ago, has grown up to be — by global standards — a medium-size business. And that bestows on our family a serious responsibility. The last line of Patagonia’s mission statement is “… use business to inspire and implement solutions to the environmental crisis.” We’ve always taken that seriously.</p>

<p>Three examples: Every year for 30 years, Patagonia has donated one percent of its sales to grassroots environmental organizations. We helped initiate the Sustainable Apparel Coalition, an organization of companies that produces more than a third of the clothing and footwear on the planet. In a very short time, the Coalition has launched an index of social and environmental performance that designers (and eventually consumers) can use to make better decisions when developing products or choosing materials. And last year we became one of California’s first B Corps (benefit corporations), which means that the values that helped make our company successful are now etched into our legal charter.<br />
Now is the time for Patagonia to take the next logical step: to reach out beyond the framework of the apparel and outdoor industries. Today, my family and I are happy to launch $20 Million &amp; Change, an internal fund to help like-minded, responsible start-up companies bring about positive benefit to the environment.</p>

<p>With the launch of this fund, we have reorganized Patagonia and our other businesses within a new holding company called Patagonia Works. While most holding companies are about diversification, Patagonia Works is dedicated to a single cause: using business to help solve the environmental crisis. Rose Marcario, who has been COO and CFO of Patagonia’s apparel company, will now take on a new role as President and CEO of Patagonia Works. Rose has been instrumental in tripling profits for our company. We now want to apply her business acumen and keen sense of social and environmental responsibility to new companies in five critical areas: clothing, yes, but also food, water, energy and waste. Rose has been responsible for the launch of Patagonia Provisions, which will soon expand beyond our Wild Salmon Jerky (wild-caught in natal waters by First Nations tribes) to other foods that, like our jerky, are more thoughtfully sourced. The food business is, as much as the apparel or energy industries, environmentally broken. It takes more from the planet than it gives back. We aim to find ways to get what we want to eat by working with nature rather than against it.</p>
<p>Casey Sheahan will continue to serve as President and CEO of Patagonia, Inc., the clothing company at the heart of Patagonia Works.</p>
<p>Others might see Patagonia Works and $20 Million &amp; Change as revolutionary business ventures; we think both are just next logical steps to doing business more responsibly. Economic growth for the past two centuries has been tied to an ever-spiraling carbon bonfire. Business – and human – success in the next 100 years will have to come from working with nature rather than using it up. That is a necessity, not a luxury as it’s seen now in most business quarters. Kelly Slater dealt blow as investment company falters</p>
<p>The Kelly Slater Wave Company has been dealt a blow with today&#8217;s announcement that LM Investments has been placed into voluntary administration. LM Investments is being investigated by the Australian Securities and Investments Commission for multiple breaches of corporation law.</p>
<p>LM Investments is a fund manager that reportedly holds $3 billion worth of investors funds and operates in 70 countries. In a recent ABC investigation LM Investments were found to be making misleading claims about its operations and were involved in a dubious property development called Maddison Gardens at Pimpana, north of the Gold Coast. 62.5% of LM Investments entire portfolio is invested in Maddison Estate.</p>

The scandal erupted last week when someone noticed the connection and sent it viral around the internet.<br />
Turns out, according to this letter we got from the president of Santa Cruz Skateboards this morning, the original artists and the skate company didn&#8217;t know about Mr. Scott&#8217;s collection at all. Uh-oh.</p>
<p>Somewhere, there are lawyers are rubbing their hands together in anticipation of a showdown.</p>

<p><strong><em>We had never heard of Jeremy Scott until it was brought to our attention. This is not a collaboration or under license, nor did we or the Phillips family approve the use of this artwork on his apparel designs in any way.</em></strong></p>
<p><strong><em>It&#8217;s obvious to us, the Phillips family, the fans of Jim Phillips Sr. and Jimbo Phillips, and fans of the brand Santa Cruz Skateboards, as well as many in the global skateboard and skate art community that there is clear and obvious infringement by Mr. Scott. We are discussing this with our legal team to determine our next steps.</em></strong></p>
<p><strong><em>These two artists and this brand are iconic. Any true fan of skateboarding will tell you how the Phillips artwork style, this brand and the activity of skateboarding has positively influenced their lives. It may just be artwork to Mr. Scott, to be used and thrown away by next season, but these artists and brand mean a lot to many people around the world. And by the looks of the outcry on social media, skateboarders and non-skater&#8217;s alike are angry to have two of their most favored artists and one of the original true skateboard brands violated in such a way.</em></strong></p>
<strong><em>I hope that Mr. Scott sees that his actions have hurt and affected many people, including the Phillips family, and that he has also severely damaged his own reputation. <p><strong><em>Many people have concluded that Jeremy Scott must have obtained a copy of Jim Phillips Sr. book &#8220;The Skateboard Art of Jim Phillips&#8221; published in 2007.</em></strong></p>
<p><strong><em>There is some obscure art in the book that Jeremy Scott lifted and it could only have come from that book.</em></strong></p>

Patagonia Inc., a leading designer of core outdoor, surf and sport-related apparel, equipment, footwear and accessories, formally announces today the newest member of its surf ambassador team – Ramon Navarro.<br />
“Ramon embodies the values we strive to promote,” says Jason McCaffrey, Patagonia’s Director of Surf. “He’s a straight-shooter that walks the talk and his commitment to the protection of the Chilean coast is unwavering.”<br />
Navarro grew up in the seaside town of Pichilemu, Chile. His father is an artisan fisherman and free diver who taught Ramon a deep respect for the ocean. He began surfing at age 13 and has gone on to become one of the world’s most respected big-wave surfers. He made it to the finals of the prestigious Eddie Aikau in 2008-2009, finishing on the podium in 5th place and winning the event’s Monster Drop award. He was runner up for the XXL Ride of the Year in 2010, 2nd at the 2011 Punta de Lobos, and is currently nominated for Barrel of the Year for an incredible ride this past summer in Fiji.<br />
“He is without a doubt one of the best big wave surfers on the planet,” says big-wave surfer Ian Walsh, “The way he was reading waves and surfing them on that huge swell this summer in Fiji was really inspiring to watch.”<br />
“Ramon is one of my favorite surfers to share a big wave session with,” says 2011 Monster Paddle-In Winner Shane Dorian. “He’s so quiet, humble and friendly, but when there is a bomb coming in and its go-time, he puts his head down and charges with the best of ‘em.”<br />
 “He knows the ocean as well as anybody and has an innate talent for getting the best waves of the session,” says Ramon’s big-water mentor and fellow Patagonia surf ambassador, Kohl Christensen, “and more importantly, he cares about his country, his family and friends, and about his environment. He has one of the biggest hearts of anyone I know.” Kohl and Ramon will be working hand-in-hand with Fletcher Chouinard of FCD Surfboards to refine and develop surfboards for big waves.<br />
Apart from his success in big wave surfing, Patagonia was drawn to him by his environmental commitment. “Ramon fits right into the Patagonia familia”, says Chris Evans, Patagonia’s Latin America Director. “He’s a world-class but unassuming athlete that also stands up against pulp mill pollution and sewage pipelines. And when an 8.8 earthquake rocked Chile in 2010 Ramon led an inspired relief effort for those hardest hit.” As further testament to his pioneering spirit and big-wave prowess beyond Chile’s giant surf, National Geographic has nominated Ramon as one of the top ten 2013 Adventurers of the Year.<br />

<p>Details were announced this week of Wavegarden UK, an exciting new leisure development for Bristol that will bring surfing, nature, education and the community together to make a brilliant day out for everyone.</p>
<p>Wavegarden UK will use new technology to create perfect surfing waves up to 1.6 metres high on a 450 metre man-made lake close to the city centre.  Good surfers will be able to enjoy a 55 second long ride, whilst beginners will be able to learn to surf in a safe environment. </p>
<p>In addition to the surfing, the gardens surrounding the lake will be specifically designed to provide a healthy, educational, sensory experience.  This means children can play, learn and have fun, grown-ups can relax and there will be easy access for people of all abilities. The aim is to help everyone visiting Wavegarden get in touch with nature and maybe discover something new. </p>
<p>Wavegarden is the idea of two Bristol friends, Nick Hounsfield (an osteopath) and Tobin Coles (a corporate marketing director).  Both are surfers and have a vision of creating a space in Bristol for all the community to enjoy and get close to nature.  Nick and Tobin are joined by Chris Hines MBE, founder of Surfers against Sewage and former director of sustainability at the Eden Project.</p>
<p>There are a number of possible sites for the Wavegarden development, one of which is a 13 acre former sports field situated alongside the Portway in the Avon Gorge.</p>
<p>At this morning’s announcement the Wavegarden UK team confirmed that the first essential step is a period of public consultation where they will gather the views of Bristol people and feed these into the design development process.  Full public consultation and an exhibition of the proposed plans are scheduled to follow in the early part of next year.</p>
<p>Talking about the plans for Wavegarden, Nick said: “Wavegarden is ambitious but achievable. It will be a fantastic place, close to Bristol city centre, that everyone can enjoy – all ages, all backgrounds and all abilities. It will be a space to relax and rehabilitate as well as a place to surf, play and have fun. We instinctively know that being in or around water is good for people and that is something we want to share!”</p>
<p>Tobin added: “It’s very important to us that we get as many views as possible on the project from the public and feed these in to the design process. We really want the final plans for the site to be something that reflects what the people of Bristol have said to us – and that meets their needs.” </p>
<p>Chris Hines will be developing Wavegarden’s sustainability policy. He explains: “I’m backing this project as I believe in Nick and Tobin’s vision of a place where people from all backgrounds can have fun and get in touch with nature on a site close to the main population of Bristol. We want to build Wavegarden in tune with its surroundings &#8211; we’ll minimise our environmental foot print, build links with the Bristol community and be financially prudent whilst ensuring our output of waves, fun and relaxation is as great as possible!”</p>

<p>Update 17/01/12:<br />
Because of increasing and significant public demand, and to fully support the fantastic reception to the announcement of Wavegarden UK&#8217;s project in Bristol, Wavegarden (the creators of the technology) have decided to allow limited public access to their new, larger, state of the art development facility near San Sebastian, in the north of Spain. </p>
<p>This will not only allow continued refinement of their exciting wave technology but will also allow Wavegarden partners across the world to demonstrate elements such as energy consumption, capacity and queuing systems before the first full commercial launch.</p>
<p>Co-founder of Wavegarden UK, Nick Hounsfield, said: &#8220;We are working closely with Wavegarden and the fact that they will allow limited public access to their test facility this spring is very exciting. The facility in Spain is the showroom of the Wavegarden technology and differs from the UK project in a number of areas including facilities, ride time, lake size etc. For us, the surrounding gardens will be equally important as the wave and will be specifically designed to provide a healthy, educational and sensory experience. “I&#8217;m sure there will be a lot we can continue to learn from Wavegarden and we are sure it will be a great success, I can&#8217;t wait to go and visit it!&#8221; </p>

&#8220;<em>Recently an article was published on SwellNet that called into question the inspiration and development of our Wave Company, and I thought I’d share my perspective on things. The timing works out pretty well given that the United States Patent and Trademark Office accepted eighteen out of our twenty-one claims filed yesterday. There are still some corrections to be made, but we’re well on our way.</p>
<p>First off, the patent process is a trying one. Something like 98% of patents are rejected in the first attempt. Webber’s original was actually rejected, but this was not mentioned in the Swellnet article.</p>
<p>There are clear differences in our technologies, and even Webber is aware enough about that to have modified and re-applied for a patent to include the core idea exclusive to our technology which is a “Solitary Wave.” Greg himself can tell you the difference between a Kelvin Subcritical Wave (boat wake/wind swell wave) that I believe he is producing and a Soliton or Solitary wave (groundswell) that we are producing. The fact that he has re-applied for a further patent 9 months ago to include Solitary Waves makes me wonder where he might’ve changed his mind on this. It was not a part of his original patent idea. I spoke about this being the key to our technology shortly after our patent application.</p>
<p>Greg and I spoke at lengths probably 5-6 yrs ago in Coolangatta about wave pools but didn’t catch on to the fact that we were both actually making our own, probably because we were both being tight-lipped or maybe didn’t realize the other was serious. I’m sure we were both unaware the other was in motion to make them. At one point about two years ago we could possibly have joined forces, but we were both too far down the road on what we’d worked separately on for years. I obviously knew he was surfing behind boats (and to tell you the truth I’d love to do that with them cause it looks like a blast) but to be honest, it is a boat wake combined with a displacement of water as opposed to surfing a proper wave.</em>&#8221;</p>

				<content:encoded><![CDATA[<p>Here&#8217;s a follow-up to a story we ran a couple of weeks ago about Kelly Slater&#8217;s wave pool. Turns out, it isn&#8217;t necessarily his.<br />
KS and his team have recently had some trouble getting the circular wave pool design approved by the US Patent office because long-time Australian surfboard designer and entrepreneur, Greg Weber had actually come up with and been granted a patent for something very similar, three years before Slater applied.</p>

<p><em>Inspiration can arrive at any moment, while sitting under an apple tree or standing on a shoreline. It can also take many forms. Everyone knows the story of Isaac Newton and the falling apple, but for surfer and inventor, Greg Webber, inspiration arrived in the shape of a small wave breaking along a riverbank. His eureka moment led him to make an award-winning film and also design a wave pool that he says will presage a surfing revolution. First, however, he must stave off a challenge by the most famous person in surfing.</p>
<p>In 2001 Webber stood on the deck of a fishing trawler on the Clarence River in northern NSW. He noticed the boat&#8217;s wake creating miniature waves along the shoreline and was captivated by their perfect shape. Enthused by the potential he began to experiment with the wake off his own runabout, changing angles and distance and noticing the effect it had on the quality of waves. He called on his brother Monty who began filming the waves, shooting them from various angles but always careful to leave the source of the waves – the boat – out of picture.</p>
<p>In 2004 Monty Webber released a movie comprised entirely of boat wake footage. Liquid Time won awards at surf film festivals despite not featuring a single surfer nor any waves over two feet high. The power of Liquid Time lay in evocation; with no way to reference their size, and with the boat out of frame, viewers imagined these tiny waves to be wind-borne waves on the ocean. The physical properties were identical, but best of all the waves in Liquid Time were perfect – utterly perfect.</p>
<p>For Greg Webber the inspiration didn&#8217;t end there. In 2004 he lodged a patent with the US Patent Office for a wave pool that incorporated the same elements as the boat wakes they&#8217;d been filming. Webber&#8217;s design featured a large circular pool with an island in the middle. An object similar to a boat hull moved around the outer edge of the pool displacing water and sending a wake toward the inner island. The wake broke around the island providing a theoretically endless wave.</p>
<p>The patent was approved in 2005 and Webber established a company to commercially develop the wave pool. The name of the company: Liquid Time.</p>
<p>Webber assembled engineers and for the next five years years they researched the physics behind wave pools, building a scale model at Delft University of Technology, Netherlands, and also at the Australian Maritime College, Launceston. He had success making small-scale versions of the waves and discovered the elements required for creating a perfect wave in a pool. Amongst them was running a counter-current around the pool to stand the wave up vertically so it barrels.</p>
<p>All the while Webber sought investment in his wave pools and teamed up with an American water park construction company, Michael Lee Designs, in preparation for roll out in the US market. &#8220;If there&#8217;s a 1000 water parks in America then how on Earth can&#8217;t there be 100 wave pools?&#8221; said Webber when asked about the future of wave pools.</p>
<p>Yet despite holding the only US patent for pools of this kind Greg Webber is not the name that comes to mind when most people think of wave pools. In 2008 Kelly Slater formed the Kelly Slater Wave Company, and since its inception he&#8217;s been creating and testing wave pools with a design very similar to Webber&#8217;s.</p>
<p>Recently Slater leveraged his celebrity with a six minute video on America&#8217;s CBS News that included discussion about his wave pools as a post-career business venture. The Kelly Slater Wave Company also released a promotional video just prior to his latest world title win.</em></p>
